Helping to draft prenups for all types of couples

When drafted properly, a specific type of agreement can serve the interests of two people who are about to marry. Writing a prenuptial agreement, however, can be tricky. Unless someone is in the legal field, coming up with a prenup that will stand up in divorce proceedings is usually hard to do.

Attorneys at The Mandel Law Firm routinely help couples throughout New York City-Brooklyn, Manhattan, Queens, the Bronx and Staten Island-negotiate and draft prenuptial agreements. Our family law attorneys have decades of experience in helping couples protect their assets, both heterosexual and same-sex couples. Drafting a post-nuptial or prenuptial agreement for a same-sex couple, however, is different and often more complicated because not every area of the law has yet caught up to include same-sex issues and concerns. Our experienced attorneys can help navigate these new waters and produce draft agreements that are applicable not only in New York but also in other states.

Many couples, both heterosexual and same-sex, are not sure about the concepts of separate and marital property. Our attorneys can attempt to clear up any confusion so that clients are clear about their options.

What if a client has children from a previous marriage? The Mandel Law Firm’s attorneys know how to protect the rights of these children and can also help with alimony, maintenance and other spousal support issues during a divorce.

Post-nuptial agreements-financial agreements between spouses drawn up during marriage-function in ways similar to prenups. However, they are often more complicated to properly draft to be enforceable. If you think you may be interested in a post-nup, you must see an attorney well versed in this area of law
